City Attorney Todd Litfin stated that Councilwoman Tara Campbell recused herself for one case on Closed Session Item B, Conference with Legal Counsel – Existing Litigation, because she has a potential conflict under Government Code Section 87100.    

City Attorney Litfin stated that Mayor Carlos Rodriguez recused himself for one case on Closed Session Item B, Conference with Legal Counsel – Existing Litigation, because he has a potential conflict under Government Code Section 87100.    

The City Council convened into Closed Session at 5:32 p.m.

The City Council/Successor Agency to the Yorba Linda Redevelopment Agency, Yorba Linda Housing Authority and Yorba Linda Municipal Financing Authority reconvened at 6:31 p.m. in the Council Chambers at 4845 Casa Loma Avenue, Yorba Linda.

City Attorney Litfin

City Attorney Litfin said there was no reportable action on the items discussed on the Closed Session agenda.  

City Attorney Litfin stated that Councilwoman Campbell recused herself for one case on Closed Session Item B, Conference with Legal Counsel – Existing Litigation, because she has a potential conflict under Government Code Section 87100.    

City Attorney Litfin said that Mayor Rodriguez recused himself for one case on Closed Session Item B, Conference with Legal Counsel – Existing Litigation, because he has a potential conflict under Government Code Section 87100.   

City Manager Mark Pulone introduced the City's new staff member Jesus Espinoza, Landscape Inspector and shared a brief overview of his career background. 

Council welcomed him to the Yorba Linda team.

City Clerk Marcia Brown said no written comments were received.

Brooke Jones, Yorba Linda Water District Director, shared that the District is once again pumping groundwater. They are able to pump 10 million gallons of groundwater a day, completely free from PFAS. This is enough for roughly 65% of the District's service population. He said wiring for a booster pump has been delayed due to Southern California Edison, and until that is complete, they will not be able to pump more groundwater than that. The District looks forward to using more groundwater as it is half the price of imported water.

Mayor Rodriguez stated that Mayor Pro Tem Gene Hernandez will abstain from Consent Calendar Item No. 2, out of an abundance of caution due to his involvement with Orange County Transportation Authority (OCTA) and the numerous contractors that may do work in the City. Mayor Rodriguez requested a brief staff report on Consent Calendar Item Nos. 5, 6 and 8.

Councilwoman Campbell moved the approval of the Consent Calendar with the revision to the February 1, 2022 meeting minutes as distributed to Council by the City Clerk in redline.

  • It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.

  • It is recommended that the City Council receive and file the accounts payable check register dated February 15, 2022, in the amount of $864,320.49.

  • It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency approve the minutes of the February 1, 2022 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting.

  • It is recommended that the City Council: 1.) approve an amendment to the Professional Services Agreement (21220101) with NV5, Inc. (NV5), increasing agreement total by $80,000 for additional Interim Public Works Inspection Services; and 2.) approve a corresponding $80,000 line-item budget transfer from various accounts to the Public Works Department Project Development Operating Budget for Temporary Inspection Services.

  • It is recommended that City Council receive and file this report.

  • It is recommended that the City Council receive and file the Annual Comprehensive Financial Report (ACFR) for the fiscal year ended June 30, 2021, and related reports from the City’s independent auditors.

  • It is recommended that the City Council direct staff to initiate planning efforts for the 2022 July 4th Fireworks Show and authorize staff to execute payment to Pyro Spectaculars, Inc. in an amount not-to-exceed $28,305.

  • It is recommended that the City Council adopt Resolution No. 2022-5787 reauthorizing teleconferenced meetings pursuant to the requirements of AB 361.

  • It is recommended that the City Council receive and file this report.

b. Staff Report  

Public Works Director / City Engineer Jamie Lai shared a PowerPoint presentation on the partial vacation of the landscape easement at 5851 Deerfoot Lane. Her PowerPoint included a map of the vacation site, an aerial view of the easement and staff's recommendation and next steps.

    It is recommended that City Council: 1.) adopt Resolution No. 2022-5784 (Attachment 2), declaring a portion of the landscape easement at 5851 Deerfoot Lane, Assessor’s Parcel Number (APN) 348-221-14, as unnecessary for present or prospective public use and vacating the same pursuant to California Streets & Highways Code Section 8300 et seq.; and 2.) direct staff to remove the existing irrigation lines, within the proposed vacation areas; and 3.) direct staff to continue to irrigate and maintain the designated areas until the final recordation of the landscape easement vacation documents are processed; and 4.) direct the City Clerk to cause a certified copy of the proposed resolution to be recorded in the Office of the Clerk-Recorder, County of Orange upon completion of any removal of irrigation equipment undertaken by the City.

    It is recommended that the City Council continue the public hearing to the March 1, 2022, Council meeting for a Resolution approving an Addendum to the 2016 Certified Environmental Impact Report (EIR) for the General Plan and approve an amendment to the Circulation Element to modify the Circulation Element Map to reclassify a portion of Savi Ranch Parkway from Yorba Linda Boulevard to Old Canal Road.

City Manager Pulone said he had no reportable items.

Councilwoman Peggy Huang provided an update on the Toll Roads 241/91 Express Connector and said all 800 channelizers have been installed on the 241, the full project was completed quicker than anticipated in just 5 days. She said the completed Northbound 241 Channelizer Project aims to promote good driving habits, prevent queue-jumpers, enhance safety and traffic flow for those transitioning from the 241 Toll Road to SR 91.

Councilwoman Haney shared that she was appointed to Placentia-Linda Hospital's Governing Board. She said it is a three-year appointment and expressed her excitement. She reminded the community that February is heart health month and urged residents to visit the Placentia-Linda Hospital website to sign up for screenings as needed, at www.placentialinda.com. Councilwoman Haney said she was also appointed to the Financial Partners Credit Union Board.

Councilwoman Campbell said a new Miss Yorba Linda and Miss Yorba Linda Outstanding Teen were recently crowned, Kiannah Dole and Madeline Smith, and she congratulated the two young ladies. She spoke of the recent grand opening for HWD Fitness and with President's Day next week, she said the community is fortunate to have a Presidential Library and urged everyone to visit. She concluded her comments by providing an update on the Bridges at Kraemer Place Homeless Shelter Advisory Board she serves on. She said field surveys for the Point In Time Count for the County, which aims to obtain accurate data on homeless numbers in order to improve services, will be February 22, 23, and 24th.

Mayor Pro Tem Hernandez said he attended the ribbon cutting for HWD Fitness, Hard Work and Dedication, and the pageant with his Council colleagues. He had the opportunity to attend the Yorba Linda vs. Notre Dame High School girls basketball game where Yorba Linda High School was victorious. He said Mayor Rodriguez was there with a trophy his youth basketball team had won. Mayor Pro Tem Hernandez shared that OCTA has been dealing with a potential employee strike but announced that a tentative agreement has been reached.

Mayor Rodriguez echoed the comments about the pageant and said there was a wonderful array of talented young ladies. He spoke of Kiannah Dole's and Madeline Smith's pageant platforms, promoting childhood literacy and community kindness, respectively. Mayor Rodriguez concluded his comments by congratulating the Yorba Linda Woman's Club for 110 years of service. 

Mayor Rodriguez asked Councilwoman Huang to adjourn the meeting at 7:15 p.m. in honor of Robert Douglas Ming, a founding Board Member of the Association of California Cities – Orange County who passed away on February 13, 2022, to the next regularly scheduled City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting on March 1, 2022.
