The City Council/Successor Agency to the Yorba Linda Redevelopment Agency convened at 5:31 p.m. in the Council Chambers at 4845 Casa Loma Avenue.

Mayor Carlos Rodriguez and Councilwoman Peggy Huang arrived at 6:15 p.m.

City Attorney Todd Litfin stated that Mayor Rodriguez and Councilwoman Huang recused themselves for one case on Closed Session Item A, Conference with Legal Counsel – Anticipated Litigation, Significant Exposure to Litigation, because they have a potential conflict of interest.

The City Council convened into Closed Session at 5:32 p.m.

The City Council/Successor Agency to the Yorba Linda Redevelopment Agency, Yorba Linda Housing Authority and Yorba Linda Municipal Financing Authority reconvened at  6:32 p.m. in the Council Chambers at 4845 Casa Loma Avenue, Yorba Linda.

City Attorney Litfin said there was no reportable action.

Mayor Rodriguez invited Mr. Paul Charlton, Junior United Soccer Association President to the podium and presented him with a certificate of recognition in appreciation of his volunteer efforts and those of the JUSA Board. Council thanked him and the Board for their commitment to working with the community's youth.

Pat Buttress, representative of Supervisor Don Wager's office also presented a certificate. Mr. Charlton expressed his gratitude for the recognitions.

Yorba Linda Chamber of Commerce Chief Executive Officer Susan Wan-Ross shared a PowerPoint of the Chamber’s Quarterly Update which included an overview of their 2022 Board of Directors and highlights from events in the third quarter, including Taste of Yorba Linda, Mayors Prayer Breakfast, Wine Wednesdays and E-Waste Recyling. She spoke about their 99.6% membership retention, social media averages, COVID-19 response and shared additional statistics and photos of events.

Anthony Johnson, Chairman Elect, said the Chamber has been getting involved and staying informed on policies coming from Sacramento and Washington D.C. As a result, the Chamber prepared a Ballot Measure Guide to help business owners and residents understand the measures and what a Yes and a No vote mean. He also said that the Chamber will be starting a Government Affairs Committee.

Mayor Rodriguez recognized the July - September Businesses of the Month as Pets Supply Plus, Yorba Linda Neighbors, and Exodus Escape Room respectively. Council congratulated the businesses and wished them continued success.

Ms. Buttress, representative of Supervisor Don Wager's office also presented a certificate.

Next, Mayor Rodriguez recognized Eureka Pizza Co. as the City's Business of the Quarter for the third quarter. Steve and Patricia Bangos accepted the recognition and expressed their gratitude to Council and the community.

Pat Buttress, representative of Supervisor Don Wagner's office also presented the Businesses of the Quarter with a certificate.

Tony Cardenas, Public Affairs Regional Manager for the League of California Cities (LOCC), presented Mayor Pro Tem Hernandez with a recognition from the State of California for his participation on the LOCC Board. 

Anita Hynds, resident, spoke about the Constitution and the importance of law-abiding leadership. 

Mayor Rodriguez stated that Mayor Pro Tem Hernandez will abstain from Consent Calendar Item No. 2, out of an abundance of caution due to his involvement with Orange County Transportation Authority (OCTA) and the numerous contractors that may do work in the City.

  • It is recommended that the City Council approve the Consent Calendar with the revision to the October 4, 2022 meeting minutes as distributed to Council by the City Clerk in redline.

  • It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.

  • It is recommended that the City Council receive and file the accounts payable check register dated October 18, 2022, in the amount of $961,737.67

  • It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency approve the minutes of the October 4, 2022 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting.

  • It is recommended that the City Council: 1.) Receive and file the attached monthly Treasurer’s Report; and 2.) Delegate investment responsibility to the City’s Finance Director / City Treasurer for a period of up to one year.

  • It is recommended that the City Council: 1.) Authorize the proposed improvements (concrete hardscape, patio cover, electrical lines, sewer and water lines, propane barbeque, sink, gate, and low-growth landscaping) to encroach within the City’s storm drain easement at 4067 Elsie Drive; and 2.) Determine such encroachments will not adversely impact the City’s normal use of the easement for storm drain purposes, and 3.) Require the homeowner to execute a Declaration of Restrictive Covenants Agreement pursuant to City Council Policy E-5.

  • It is recommended that the City Council approve Change Order No. 1 (Attachment 1) to the construction contract with Onyx Paving Company, Inc. for the Fiscal Year 2021-22 Annual Pavement Preservation Project -Zone 6 (SI221009) in the amount of $350,200.

  • It is recommended that the City Council take the following actions: 1.) Approve plans and specifications for the City Hall Landscape Renovation Project; and 2.) Award the contract for construction of the City Hall Landscape Renovation Project to Nieves Landscape, Inc., of Santa Ana, CA in the amount of $136,680.05 and reject all other bids, and 3.) Authorize the Mayor to sign and City Clerk to attest said agreement.

  • It is recommended that the City Council authorize the City Clerk to: 1.) Release 75 percent of the Rough Grading Bond; 2.) Release 75 percent of the Faithful Performance/ Labor and Materials Bond for On-site Storm Drain Improvement; and 3.) Release 60 percent of the Faithful Performance/ Labor and Materials Bond for On-site Street Improvements.

  • It is recommended that the City Council receive and file this report.

City Manager Mark Pulone did not have a report. 

Councilwoman Huang said Consent Calendar Item No. 10 has an informative article from Laboratory Report, October 20, 2022 - Vectors of the Month on mosquitos and what attracts them to humans.

Councilwoman Tara Campbell announced the upcoming Yorba Linda Woman's Club Craft Fair on November 5th and 6th at the Yorba Linda Community Center. 

Mayor Pro Tem Hernandez reminded the community that Public Comment is open to anything that residents wish to express, which many times does not reflect the views or feelings of the Council.

Mayor Rodriguez announced that tomorrow at 7:45 p.m. he will give his State of the City Address with the theme of "The Future of Yorba Linda" at the Richard Nixon Presidential Library and Museum. The event will be live-streamed through the City website and Facebook page for those that cannot attend but wish to enjoy the event from home. He urged the community to visit the City's website for details. Mayor Rodriguez concluded his comments by sharing that the City Council will recognize Yorba Linda Veterans at the November 1st Council meeting and asked residents to contact Mark Aalders, Assistant to the City Manager to be included in the presentation.  

Public Works Director / City Engineer Jamie Lai provided a brief staff report on the item and said the Local Road Safety Plan (LRSP) was fully funded by a grant received from CalTrans a few years ago and said the LRSP is a prerequisite for any future highway safety improvement grants from the State or Federal government. Director Lai invited Ruta Jariwala, Principal of TJKM to provide a PowerPoint overview of what a Local Road Safety Plan is, its overarching goals and the results of their study for Yorba Linda. She discussed the community engagement for the LRSP, input received as well as key stakeholders involved, collision analysis findings and high-injury intersections and improvements.  Ms. Jariwala said seven safety projects were identified, including improvements at signalized intersections, spot location improvements at signalized improvements, systemic and spot improvements at unsignalized intersections and systemic improvements at roadway segments. She concluded with an implementation and next steps overview.

Anthony Johnson, Traffic Commissioner, urged Council to approve the staff recommendation and adopt the plan.

Richard de Bruijn, resident, conveyed his approval for the plan which he believes was well thought out and well done. He expressed concerns with the ingress and egress into Savi Ranch as well as the speed along Bastanchury Road and the already funded improvements for that area.

A lengthy conversation ensued among the Council regarding grants and eligibility, the level of community involvement, and the prioritization of projects. 

  • It is recommended that the City Council approve and adopt the Local Roadway Safety Plan (LRSP) as a guideline for seeking future highway safety improvements grant opportunities.
