***SPECIAL NOTICE REGARDING COVID-19***

Effective December 15, 2021 the California Department of Public Health (CDPH) issued a requirement for masks to be worn in all indoor public settings, irrespective of vaccine status, until January 15, 2022.

Pursuant to Executive Orders N-60-20 and N-08-21 executed by the Governor of California, and subsequently Assembly Bill 361 (AB 361, 2021), enacted in response to the state of emergency relating to novel coronavirus disease 2019 (COVID-19) and enabling teleconferencing accommodations by suspending or waiving specified provisions in the Ralph M. Brown Act (Government Code § 54950 et seq.), members of the public, the City Council, the City Manager, City Attorney, City Staff, and City Consultants may participate in this regular meeting by teleconference.

This meeting will be accessible to the public via cable channel 3,  and electronically, to promote social distancing during the coronavirus (COVID-19) pandemic. In order to ensure the safety of the public, City Council and staff, in-person public participation at the meeting of the City Council will not be allowed. Instead, members of the public can watch the televised meeting, or view it online via the City’s website.

CONSENT CALENDAR

All matters listed under "CONSENT CALENDAR" are considered by the City Council/ Successor Agency to the Yorba Linda Redevelopment Agency, Yorba Linda Housing Authority and Yorba Linda Municipal Financing Authority to be routine and will be enacted by one motion approving the recommendation listed on the Agenda. • Recommendation:

  It is recommended that the City Council approve the Consent Calendar.

1.   WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA

• Recommendation:

  It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.

2.   ACCOUNTS PAYABLE CHECK REGISTER – DECEMBER 21, 2021

• Recommendation:

  It is recommended that the City Council receive and file the accounts payable check register dated December 21, 2021, in the amount of $2,201,438.73.

3.   APPROVAL OF THE MINUTES OF THE DECEMBER 7, 2021 CITY COUNCIL / SUCCESSOR AGENCY TO THE YORBA LINDA REDEVELOPMENT AGENCY MEETING

• Recommendation:

  It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency approve the minutes of the December 7, 2021 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting.

4.   APPROVAL OF THE MINUTES OF THE DECEMBER 14, 2021 CITY COUNCIL / SUCCESSOR AGENCY TO THE YORBA LINDA REDEVELOPMENT AGENCY SPECIAL MEETING

• Recommendation:

  It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency approve the minutes of the December 14, 2021 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint special meeting.

5.   MASTER PLAN OF DRAINAGE DEVELOPMENT IMPACT FEES ANNUAL REPORT FOR FISCAL YEAR 2020/21

• Recommendation:

  It is recommended that the City Council receive and file the annual report of Master Plan of Drainage development impact fees for the fiscal year ended June 30, 2021, as required by the Mitigation Fee Act.

6.   TRAFFIC DEVELOPMENT IMPACT FEES ANNUAL REPORT FOR FISCAL YEAR 2020/21

• Recommendation:

  It is recommended that that the City Council receive and file the annual report of traffic development impact fees for the fiscal year ended June 30, 2021, as required by the Mitigation Fee Act.

7.   2020-2021 BLACK GOLD GOLF CLUB FISCAL YEAR IN REVIEW

• Recommendation:

  It is recommended that the City Council receive and file this report.

8.   ELECTRIC VEHICLE CHARGING STATION RATES AT THE LIBRARY AND ARTS CENTER

• Recommendation:

  It is recommended that the City Council adopt Resolution 2021-5776 to implement a new electric vehicle charging station rate structure for the Library and Arts Center as well as ratify the electric vehicle charging station rate structure at the Town Center Parking Structure.

9.   APPROVE PROFESSIONAL SERVICE AGREEMENT WITH HARRIS AND ASSOCIATES FOR ENGINEERING SERVICES IN PREPARING DESIGN PLANS AND SPECIFICATIONS FOR THE ANNUAL PAVEMENT PRESERVATION PROGRAM - ZONES 5 AND 6

• Recommendation:

  It is recommended that the City Council approve a Professional Service Agreement with Harris and Associates in the amount of $260,295 for engineering services in preparing design plans and specifications for the Fiscal Year 2021/22 & 2022/23 Annual Pavement Preservation Program (APPP) - Zones 5 and 6.

10.   AWARD OF A PROFESSIONAL SERVICES AGREEMENT TO NCE ENGINEERING FOR PREPARATION OF THE 2022 CITYWIDE PAVEMENT MANAGEMENT (PMP) PROGRAM

• Recommendation:

  It is recommended that the City Council award a professional services agreement to NCE Engineering for preparation of the 2022 Citywide Pavement Management Program (PMP).

11.   AWARD OF A PROFESSIONAL SERVICES AGREEMENT WITH LIN CONSULTING, INC. FOR THE LA PALMA AVENUE IMPROVEMENT FEASIBILITY STUDY

• Recommendation:

  It is recommended that the City Council award a professional service agreement to Lin Consulting, Inc. in the amount of $99,452.00 for the La Palma Avenue Improvement Feasibility Study.

12.   ANNUAL MEETING AND CONFIRMATION OF OFFICERS FOR THE AUTHORITY

• Recommendation:

  It is recommended that the City Council acting as the Board of Directors of the Yorba Linda Municipal Financing Authority confirm and appoint the officers of the Authority as follows:

13. CONTRACT EXTENSION WITH PFM ASSET MANAGEMENT, LLC

• Recommendation:

  It is recommended that the City Council approve a contract extension with PFM Asset Management, LLC on a month-to-month basis for a maximum period of one year.

14.   WAGE ADJUSTMENTS FOR NON-REPRESENTED PART TIME POSITIONS

• Recommendation:

  It is recommended that the City Council Adopt Resolution No. 2021-5778 related to the compensation of non-represented part time employees.

15.   REVISIONS TO PERSONNEL POLICIES AND PROCEDURES MANUAL

• Recommendation:

  It is recommended that the City Council: 1.) approve a revision to the City’s Personnel Policies and Procedures Manual by adopting Resolution No. 2021-5777, and 2.) Repeal Resolution No. 2020-5730.

16.   RELEASE SURETY BONDS, PARCEL MAP 2015-113 – ZELMAN DEVELOPMENT COMPANY

• Recommendation:

  It is recommended that the City Council authorize the City Clerk to: 1.) Release 100% of the Public Improvement Faithful Performance/Labor and Material Bond; and 2.) Release 100% of the Monumentation Bond.

17.   FISCAL YEAR 2021/22 FIRST QUARTER BUDGET UPDATE

• Recommendation:

  It is recommended that the City Council receive and file the attached list of line-item budget transfers and supplemental budget appropriations for the first quarter of FY 2021/22 (Attachment 1), as required by City Council Policy F-4 – Supplemental Budget and Line-Item Transfers.

18.   REPORTS OF PLANNING COMMISSION ACTIONS FROM THEIR LAST MEETING

• Recommendation:

  It is recommended that the City Council receive and file this report.

20.   ADOPTION OF URGENCY ORDINANCE NO. 2021-1088 APPROVING ZONING CODE AMENDMENT ZCA 2021-01 – AN AMENDMENT TO CHAPTER 18.20 OF THE YORBA LINDA ZONING CODE TO ADD REGULATIONS PERTAINING TO SENATE BILL 9 HOUSING DEVELOPMENTS AND URBAN LOT SPLITS

• Recommendation:

  It is recommended that the City Council adopt Urgency Ordinance No. 2021-1088 approving Zoning Code Amendment ZCA 2021-01 to add regulations to Chapter 18.20 of the Yorba Linda Zoning Code related to Senate Bill 9 housing developments and urban lot splits.
