The City Council/Successor Agency to the Yorba Linda Redevelopment Agency convened at 5:30 p.m. in the Council Chambers at 4845 Casa Loma Avenue.

City Attorney Todd Litfin stated that Councilwoman Tara Campbell recused herself for one case on Closed Session Item A, Conference with Legal Counsel – Anticipated Litigation, Significant Exposure to Litigation, because she has a potential conflict under Government Code Section 87100.

The City Council convened into Closed Session at 5:31 p.m.

The City Council/Successor Agency to the Yorba Linda Redevelopment Agency, Yorba Linda Housing Authority and Yorba Linda Municipal Financing Authority reconvened at 6:37p.m. in the Council Chambers at 4845 Casa Loma Avenue, Yorba Linda.

City Attorney Litfin said there was no reportable action on the items discussed on the Closed Session agenda.  

City Attorney Litfin stated that Councilwoman Campbell recused herself for one case on Closed Session Item A, Conference with Legal Counsel – Anticipated Litigation, Significant Exposure to Litigation, because she has a potential conflict under Government Code Section 87100.

General Manager Rich Cessna provided a PowerPoint presentation highlighting statistics for FY 2020-21 and COVID-19 pandemic impacts. Since Federal/State governments and health officials had declared golf a safe activity during the pandemic, golf participation reached an all-time high. He said the number of first-time golfers was a record 3 million, and female golfers rose by approximately 450,000 in 2020. Mr. Cessna spoke about the growth in the industry and its effects on equipment sales and backorders. He also spoke about revenue improvements including green fees and driving range fees, as well as revenue challenges such as food & beverage (Derricks Grille), weddings, banquets and the Yorba Linda City Championship. He provided an overview of revenue trends in the industry by segment over the last 5 years, and also spoke about the website, social media and upcoming projects including new maintenance equipment, clubhouse interior improvements, wedding lawn improvements and furniture replacement. He concluded his review by discussing supply chain, inflation, minimum wage increases, irrigation system and drought challenges.

Sergeant Dave Holloway spoke briefly about smash and grab theft trends and said Yorba Linda Police Services is working with the FBI, CHP and many other agencies to share intelligence and best practices to help prevent these locally. He said they frequently meet with local business owners to provide education and community outreach through neighborhood watch meetings and social media. Sergeant Holloway reminded residents that they can request vacation checks for their homes while away and urged residents to report suspicious activity.

Brooke Jones, Yorba Linda Water District Director, said the PFAS Water Treatment Plant has been up and running as of yesterday and the impact fee will conclude on December 31st. He said the District has been receiving water from the Colorado River when groundwater has not been available, but there is hope that the upcoming storms will bring much-needed water to the State. Director Jones said at times the District may need to help neighboring districts when there is a water need and urged residents to conserve water.

Mayor Rodriguez stated that Mayor Pro Tem Gene Hernandez will abstain from Consent Calendar Item No. 2, out of an abundance of caution due to his involvement with Orange County Transportation Authority (OCTA) and the numerous contractors that may do work in the City.

Approval of the Consent Calendar balance was MOVED BY Mayor Pro Tem Hernandez and SECONDED BY Councilwoman Peggy Huang.

City Manager Mark Pulone recommended a continuance of Item No. 11, Award of Professional Services Agreement with Lin Consulting, Inc. for the La Palma Avenue Improvement Feasibility Study, to the next Council meeting and the motion was amended by Council.

    It is recommended that the City Council approve a Professional Service Agreement with Harris and Associates in the amount of $260,295 for engineering services in preparing design plans and specifications for the Fiscal Year 2021/22 & 2022/23 Annual Pavement Preservation Program (APPP) - Zones 5 and 6.

    It is recommended that the City Council award a professional services agreement to NCE Engineering for preparation of the 2022 Citywide Pavement Management Program (PMP).

    It is recommended that the City Council approve a contract extension with PFM Asset Management, LLC on a month-to-month basis for a maximum period of one year.

a. Open Public Hearing - Mayor Rodriguez opened the public hearing.

b. Staff Report  

Community Development Director David Brantley shared a PowerPoint presentation on this item. He spoke about Zoning Code Amendment 2021-01 related to Senate Bill 9 Housing Developments and Urban Lot Splits. He said the urgency ordinance was taken to the Planning Commission and recommended for approval to the City Council on December 15th. Director Brantley said if the urgency ordinance is adopted, it will go into effect immediately since the new state law (SB 9) goes into effect on January 1, 2022.

Planning Manager Nate Farnsworth spoke about the details of the ordinance and the effects of SB 9 if an ordinance were not adopted. He said all single-family zoned parcels are eligible for SB 9 housing developments and urban lot splits per state law. Parcels may not be in environmentally unsafe or sensitive areas, nor located in a historic district. Parcels cannot be further subdivided through SB 9 nor can adjacent parcels under the same ownership use SB 9. Planning Manager Farnsworth spoke about the SB 9 housing development local regulations proposed in the ordinance, such as one parking space per unit, only one exterior entrance on street-facing elevations, and solar panel requirements. He spoke about the urban lot split state law regulations and the proposed local regulations.

A conversation ensued among Council regarding the impacts of SB 9 and the urgency ordinance.

    It is recommended that the City Council adopt Urgency Ordinance No. 2021-1088 approving Zoning Code Amendment ZCA 2021-01 to add regulations to Chapter 18.20 of the Yorba Linda Zoning Code related to Senate Bill 9 housing developments and urban lot splits.

City Manager Pulone spoke about the work stoppage at Republic Services that ended on December 16th. He said it impacted the City as well as neighboring cities and the company is still working to catch up on service. He shared that the City has four trash drop-off locations, one at Brush Canyon, Eastside Community, Las Palomas, and Veterans Park for residents who need to dispose of waste. He also said that the City was notified after the last Council meeting of buffering issues during the live feed. The City has been in contact with AT&T to remedy this and staff will continue to monitor the broadcast.

Councilwoman Campbell said she attended the Holiday Boat Parade and thanked East Lake for continuing that tradition. She also participated in the Orange County Fire Authority Canned Food Drive that has been hosted by the firefighter reserves for over 25 years. She announced the Holiday at the Paseo, tomorrow from 5:00 p.m. to 7:00 p.m. at the new Cultural Arts Center and wished everyone happy holidays and a great New Year.

Councilwoman Huang encouraged residents to shop local this holiday season to help local businesses that are recovering from the impacts of the pandemic. She spoke about the Transportation Corridor Agency (TCA) and the money the organization saved in interest by refinancing bonds. Councilwoman Huang said TCA was recognized for its innovative approach in bond refinancing, which was the first of its kind, and since then other municipalities have followed suit. She said Orange County is a leader in preserving taxpayers' dollars.

Mayor Pro Tem Hernandez attended Hometown Heros at the Richard Nixon Presidential Library & Museum with Mayor Rodriguez. He spoke highly of the event and thanked the Gold Star families and the servicemen and women.

Mayor Rodriguez announced that the Council selected Captain Joses Walehwa as the new Chief of Police Services who will relieve Chief of Police Services Cory Martino as he was recently promoted to Commander. Mayor Rodriguez spoke briefly about Captain Walehwa's background and said he will begin serving on January 14th. Mayor Rodriguez also attended the East Lake Boat Parade with Councilwoman Campbell and the Hometown Heros event with Mayor Pro Tem Hernandez. He thanked all those involved in organizing the events as well as our servicemen and women and all the Gold Star families. He concluded by urging the community to attend the Holiday at the Paseo event tomorrow night and wished the community happy holidays.
