The City Council convened into Closed Session at 5:32 p.m.

The City Council/Successor Agency to the Yorba Linda Redevelopment Agency, Yorba Linda Housing Authority and Yorba Linda Municipal Financing Authority reconvened at 6:32 p.m. in the Council Chambers at 4845 Casa Loma Avenue, Yorba Linda.

City Attorney Litfin

Pastor Brian Long, Yorba Linda United Methodist Church

City Attorney Litfin said there was one reportable item regarding a case on Closed Session Item A, Conference with Legal Counsel – Anticipated Litigation, Significant Exposure to Litigation. Council voted 4-0, with Councilwoman Huang as absent, to enter into the national opioid settlement. 

City Attorney Litfin stated that Closed Session Item B, Conference with Legal Counsel – Existing Litigation, was not discussed due to lack of quorum with the absence of Councilwoman Huang.

City Manager Mark Pulone introduced the City's new staff member Austin Postovoit, Senior Management Analyst, and shared a brief overview of his career background. 

Council welcomed him to the Yorba Linda team.

City Manager Pulone introduced Chief of Police Services Captain Joses Walehwa and provided a brief overview of his experience and career. He said Captain Walehwa will be replacing recently promoted Cory Martino who is now serving Orange County Sheriff's Department as a Commander. 

Captain Walehwa thanked staff and residents for the support and opportunity to serve the City. 

Yorba Linda Water District Director Trudi DesRoches shared a PowerPoint presentation on the 25 MGD PFAS Water Treatment Plant. She said the District is making significant strides in bringing the treatment process into operation. She showed an aerial view of the plant highlighting the 6 prefilters where the water comes in and then proceeds to any of the 11 trains that are 12 feet in diameter and about 16 feet tall, that treat the water. She said the plant has the capacity to treat 25 million gallons of water per day and is the largest PFAS treatment plant in the nation. Director DesRoches shared a video of the ongoing construction at the plant and spoke of the construction schedule and budget.

City Clerk Marcia Brown said no public comments were received.

Mayor Rodriguez stated that Councilman Gene Hernandez will abstain from Consent Calendar Item 2, out of an abundance of caution due to his involvement with Orange County Transportation Authority (OCTA) and the numerous contractors that may do work in the City.

  • Resolution:

    It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.

    It is recommended that the City Council receive and file the accounts payable check register dated January 18, 2022, in the amount of $2,637,332.65.

  • Resolution:

    It is recommended that the City Council/Successor Agency to the Yorba Linda Redevelopment Agency approve the minutes of the December 21, 2021 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting.

  • Resolution:

    It is recommended that the City Council: 1.) Receive and file the attached monthly Treasurer’s Report; and 2.) Delegate investment responsibility to the City’s Finance Director / City Treasurer for a period of up to one year.

  • Resolution:

    It is recommended that the City Council: 1.) allow certain patio cover overhangs to be constructed and used within the City’s Storm Drain easement at the subject address, and 2.) authorize the City Manager to execute the proposed Administrative Encroachment Agreement containing covenants affecting real property with the property owner at 21525 Dunrobin Way, Yorba Linda, CA.

  • Resolution:

    It is recommended that City Council: 1.) adopt Resolution No. 2022-5780, declaring its intent to vacate a portion the landscape easement at 5851 Deerfoot Lane; and 2.) direct staff to require a release of liability agreement be executed by the property owner to allow the existing above grade irrigation lines to be left in place; and 3.) set February 15, 2022, as the Public Hearing date for the vacation process.

  • Resolution:

    It is recommended that the City Council authorize the City Manager to execute a Letter of Intent (LOI) with ForeFront Power to explore the feasibility and cost effectiveness of installing solar canopies at various City facilities.

    It is recommended that the City Council adopt Resolution No. 2022-5779 authorizing teleconferenced meetings pursuant to the requirements of AB 361.

a. Open Public Hearing  - Mayor Rodriguez opened the public hearing.

b. Staff Report  

Community Development Director David Brantley, said this item is somewhat of a duplicate of action taken at the December 21, 2021 Council meeting, that adopted an urgency version of this ordinance. He said customarily and out of an abundance of caution, staff brings the urgency ordinances back to Council through the standard ordinance adoption as a safeguard. Director Brantley said the ordinance language is the same as what was presented on December 21st.

    It is recommended that the City Council introduce Ordinance No. 2022-1089 for first reading for Zoning Code Amendment ZCA 2021-01 to add regulations to Chapter 18.20 of the Yorba Linda Zoning Code related to Senate Bill 9 housing developments and urban lot splits.

City Manager Pulone said he spoke with Councilwoman Peggy Huang earlier, and asked that he share with residents that every household in the U.S. is eligible to order four free at-home COVID-⁠19 tests provided by the Federal Government. He encouraged residents to visit the City website for more information and the link on where to order.

Councilwoman Beth Haney said she received her new City flag. She submitted her order through the City website and expressed her excitement.

Councilwoman Campbell asked the community to mark their calendars for Saturday, April 30th for Love Yorba Linda, a community-wide service day. She said she would love to see residents start signing up for projects. 

Mayor Pro Tem Hernandez wished everyone a happy New Year and said he hopes this is a better year than last year for everyone. He spoke of the organizations he is involved in and said a common discussion is whether meetings will be in person or virtual. He said despite most being virtual, organizations continue to meet in order to conduct business. He shared that he was elected as the Vice-Chair for the Orange County Transit Authority.

Mayor Rodriguez said he attended the 109th birthday celebration for former President Richard Nixon at the Richard Nixon Presidential Library & Museum on January 9, 2022 with Mayor Pro Tem Hernandez. He spoke of the ongoing pandemic and asked staff for an update on programs the City offers for senior citizens in the community. Parks and Recreation Director Mike Kudron spoke about the Seniorserv Lunch Program in partnership with Meals on Wheels. He said the City was coordinating this as a drive-thru service, but it is now a walk-in program held on Tuesdays and Fridays from 11:00 a.m. to 12:00 p.m. where seniors receive frozen meals. Director Kudron said registration is required for this program and approximately 400 meals per week are currently distributed. He also spoke of the Senior Grocery Program in partnership with the Second Harvest Food Bank; participants select from displayed groceries in the Imperial Room at the Community Center ranging from non-perishable items and produce. This program is held the first and third Thursday of each month from 8:30 a.m. to 9:30 a.m. Director Kudron concluded his comments by discussing another important program, the Senior Mobility Program in partnership with the Orange County Transportation Authority California and Yellow Cab.  Seniors can schedule a ride anywhere in Yorba Linda, or 1 mile outside the City limits seven days a week from 7:00 a.m. - 8:00 p.m. for $1 each way.

Mayor Pro Tem Hernandez added that anyone 18 and under can ride the bus for free anywhere in the County. He also reminded residents that campaign season is approaching, therefore signs will start to go up throughout cities during the Primary and General Elections. He asked residents to be patient with the signage and to be informed voters.  

Mayor Rodriguez turned the meeting over to Councilwoman Campbell who adjourned the meeting in honor of Joseph John Gruppie who passed away at the age of 87. She said he was a proud 50 year resident of Yorba Linda and shared that he and his wife Josie won a Beautification Committee award in 1973. Councilwoman Campbell spoke of his family and his service in the U.S. Army. The meeting adjourned at 7:05 p.m. to the next regularly scheduled City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting on February 1, 2022.
